Traffic offences in Germany are handled in steps. For small offences you may get a warning fine (Verwarnungsgeld). For others you first receive a hearing form (Anhörungsbogen) or a witness form (Zeugenfragebogen), then possibly a formal fine notice (Bußgeldbescheid). Against a Bußgeldbescheid you can file an Einspruch within two weeks after delivery.
Who sends these letters?
Traffic fines are issued by the fine office (Bußgeldstelle) of the city, district or police authority where the offence happened — for example for speeding, parking or running a red light. The letter is addressed to the driver if known, otherwise usually to the registered keeper of the vehicle (Halter).
The different letters
- Verwarnung mit Verwarnungsgeld: a warning with a small fine for minor offences. If you pay within the stated period, the matter is usually closed. If you do not pay, the authority can start formal fine proceedings.
- Anhörungsbogen: a hearing form. You are accused of an offence and may comment. You must give correct personal details (Angaben zur Person), but you do not have to comment on the accusation itself.
- Zeugenfragebogen: a witness form sent to the vehicle keeper if someone else may have been driving. Close relatives may have the right to refuse to testify (Zeugnisverweigerungsrecht) — the form usually explains this.
- Bußgeldbescheid: the formal fine notice. It states the offence, the fine, fees and expenses, and possibly points or a driving ban. It is officially delivered, often in a yellow envelope with the delivery date noted.
The two-week deadline
Against a Bußgeldbescheid, you can file an Einspruch (objection) within two weeks after delivery (Zustellung) — § 67 of the Administrative Offences Act (OWiG). The objection must be made in writing or recorded at the authority. If you do not object, the notice becomes final and you have to pay. Write down the delivery date from the envelope.
Higher fines can also bring points in the driving aptitude register in Flensburg (Fahreignungsregister), kept by the Federal Motor Transport Authority (Kraftfahrt-Bundesamt). Serious offences can lead to a driving ban (Fahrverbot).
Beware of fake fines
Be cautious with emails or text messages that ask you to pay a traffic fine via a link. Official German fine letters normally arrive by post and name the authority, a file number (Aktenzeichen) and bank details of a public authority. If in doubt, contact the authority using contact details you found yourself, not those in the message.
